Brazil: Apple works to solve problems related to trademark 8220; # & iPhone & # 8221;

IGB Gradient and Apple would be teaming up to find a solution with regard to the legal issues related to trademark 8220; # & iPhone & # 8221; in Brazil.

As reported by Folha de São Paulo , the most important newspaper of Brazil, it seems that IGB and Apple Gradient are working together to find a solution # & 8220; # & friendly 8221; with regard to problems relating to the trademark of 8217; # & iPhone, which owns exclusive rights Gradient following the registration of the term in 2000, years before the 8217; # & Cupertino company reveal its smartphones.

Before the expiry of the trademark by the end of 2012 Gradient moved to release a market low end called Terminal & #; 8220 8221; # & iPhone, characterized by the operating system Android 2.2 Gingerbread. The dispute was, however, initially launched by Apple to attempt to obtain ownership of the trademark in question, underscoring how the gradient had not yet released a phone until its expiration. The Brazilian National Industrial Property Institute decided to reject the request from Apple given the registration of trademark years before 8217; # & Cupertino company.

Apple could then find themselves having to pay Gradient to be able to get ownership of the trademark. At present, the Brazilian company has the right to use the name 8220; # & iPhone & # 8221; for any product, including any smartphone.
